Terms & Conditions

1. About these terms

Welcome to Trance Atelier. These Terms and Conditions ("Terms") govern your use of our website, your bookings of our services, and your purchases of our digital products. By booking a session, purchasing a product, or attending an event, you confirm that you have read, understood, and agree to these Terms.

If you do not agree with any part of these Terms, please do not proceed with a booking or purchase.

2. Who we are

Trance Atelier is a hypnotherapy and mind arts studio founded by Livia Tiwari. We provide:

—     One-to-one hypnotherapy sessions, delivered online

—     Bespoke trance commissions designed for the individual client

—     Group trance experiences in collaboration with brands, wellness venues and cultural institutions

—     Digital products, including audio recordings and access to the Trance Atelier app

—     A newsletter and editorial content

3. Eligibility

To book a session or purchase any of our services, you must:

—     Be at least 18 years of age

—     Have the legal capacity to enter into a binding agreement

—     Provide accurate and truthful information about your health and circumstances

Trance Atelier is a wellness service and is not intended for individuals experiencing acute mental health crises, severe psychiatric conditions, or circumstances that would benefit from clinical intervention. We may refer you to qualified medical or mental health professionals where appropriate.

4. Bookings

Bookings for sessions and events are made through our website. To secure a one-to-one session, a deposit of €50 is required at the time of booking. The remaining balance is due no later than 48 hours before your session, and we will send you a payment request for it. Group experience tickets, digital products, and audio memberships are paid in full at the time of purchase. A confirmation email will be sent to the address you provide.

Online sessions are conducted via secure video (Zoom or Google Meet). A meeting link will be sent before your session.

5. Pricing and payment

Prices are displayed on our website in Euros and are inclusive of any applicable taxes unless otherwise stated. Payment is processed securely through Stripe. We do not store your full payment card details.

The €50 deposit is part of the session price, not an extra charge. It is deducted from the total, and the balance is the session price minus €50. If the balance is not received by the due date, your session may be cancelled and the deposit retained (see Section 7).

We reserve the right to change pricing at any time. The price in effect at the time of booking applies to that booking.

6. Non-refundable bookings and purchases

All bookings and purchases at Trance Atelier are non-refundable, including the €50 booking deposit.

The €50 deposit secures your session time and is non-refundable. Once the balance has been paid, it is also non-refundable, subject to the rescheduling options in Section 7. This includes:

—     One-to-one sessions and commissions

—     Group experience tickets

—     Digital products, including audio recordings and app access

—     Workshop and retreat bookings

This policy reflects the bespoke nature of our services, the preparation time involved in each session, and the reservation of dedicated practitioner availability for your booking.

7. Rescheduling

We understand that life is unpredictable. Sessions and experiences may be rescheduled, subject to the following:

—     More than 48 hours before your session: you may reschedule once, free of charge, to a mutually agreed alternative date. Your €50 deposit (and any balance already paid) transfers to the new date.

—     Less than 48 hours before your session: rescheduling may be considered at our sole discretion. If we cannot offer a new date, the deposit is retained and any balance already paid is not refunded.

—     No-show or cancellation on the day: your booking is considered fulfilled. The deposit is retained, the balance remains payable, and no reschedule or refund will be offered.

—     Cancelling without rescheduling: the €50 deposit is retained. If you cancel more than 48 hours before your session and have not yet paid the balance, no balance is due.

To reschedule, contact us at hello@tranceatelier.com as early as possible.

8. Cancellation by Trance Atelier

In the rare event that we need to cancel or postpone a session or experience (due to illness, technical issues, force majeure, or other unforeseen circumstances), we will offer you:

—     The option to reschedule to an alternative date, or

—     A full refund or studio credit, at your choice

9. Your responsibilities

To make the most of our work together, we ask that you:

—     Provide accurate information about your health, medications, and any relevant conditions

—     Attend sessions rested, sober, and on time

—     Provide a quiet, private space for online sessions

—     Inform us of any changes to your circumstances that may affect your suitability for hypnotherapy

You agree not to attend a session under the influence of alcohol or non-prescribed drugs. We reserve the right to terminate any session if we have reason to believe this is the case, with no refund offered.

10. Our discretion

Trance Atelier reserves the right to:

—     Decline a booking we believe is not in the client's best interest

—     Terminate a session if we believe doing so is necessary for the client's safety or wellbeing

—     Refer clients to qualified medical or mental health professionals where appropriate

—     Refuse service to anyone whose conduct is abusive, threatening, or otherwise inappropriate

11. Confidentiality

We treat all client information with strict professional confidentiality, as detailed in our Privacy Policy. Nothing shared during a session is disclosed to any third party without your explicit consent, except in the rare circumstances required by law (for example, where there is a serious risk to life).

12. Audio recordings

For clients who book BESPOKE TRANCE, a private audio recording of the session may be made and provided to you as part of the service. This recording is for your personal use only and may not be shared, distributed, reproduced, or used for any commercial purpose.

By booking a session that includes a recording, you consent to that recording being made.

13. Digital products and app access

Purchase of digital products (including audio recordings and access to the Trance Atelier app) grants you a limited, non-exclusive, non-transferable licence for personal use only. You may not:

—     Share, distribute, copy, or resell the content

—     Use the content for any commercial purpose

—     Remove or alter any copyright or branding

All content remains the intellectual property of Trance Atelier.

14. Group experiences

Tickets to group experiences (Group Trances, Gallery Trances, workshops, and retreats) are non-refundable. By attending a group experience, you agree to:

—     Conduct yourself respectfully towards other participants, the host venue, and the practitioner

—     Arrive on time — latecomers may not be admitted once a session has begun

—     Follow any specific guidance issued by the host venue

Photographs and short video clips may be taken at events for promotional purposes. If you do not wish to appear in any documentation, please inform us in writing before the event begins.

15. Health disclaimer

Trance Atelier is a wellness studio, not a clinical service.

Hypnotherapy and our other services are not a substitute for medical, psychiatric, or psychological treatment. If you are receiving treatment for any condition, you should continue with that treatment and consult your healthcare provider before beginning hypnotherapy.

Do not stop taking any prescribed medication on the basis of our services without consulting the prescribing healthcare professional.

We make no guarantees about specific outcomes. The effectiveness of hypnotherapy varies between individuals.

16. Limitation of liability

To the fullest extent permitted by law:

—     Our total liability for any claim arising from our services is limited to the amount you paid for the relevant service.

—     We are not liable for any indirect, consequential, or incidental loss or damage.

—     We do not warrant that our services will achieve any specific outcome.

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be limited or excluded under applicable law.

17. Force majeure

We are not liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, government actions, pandemics, technical failures, or other unforeseen events.

18. Intellectual property

All content on the Trance Atelier website — including text, images, audio recordings, design, and branding — is the intellectual property of Trance Atelier and is protected by applicable copyright and trademark laws. You may not reproduce, distribute, or use any of this content without our prior written permission.

19. Changes to these terms

We may update these Terms from time to time. The "last updated" date at the top of this document indicates when the most recent revision was made. Continued use of our services after changes constitutes acceptance of the updated Terms.

20. Governing law and disputes

These Terms are governed by the laws of Belgium. Any dispute arising from or in connection with these Terms or our services will be subject to the exclusive jurisdiction of the courts of Brussels.

We encourage you to contact us first at hello@tranceatelier.com if you have any concern, so we may resolve it directly.

Important notice

These Terms and Conditions are a working draft prepared as a starting point for Trance Atelier. We strongly recommend that they are reviewed by a qualified legal professional before publication. Specific provisions — including but not limited to the non-refundable policy in light of EU consumer rights (including the 14-day right of withdrawal for distance-purchased services, which may apply unless the service is fully performed within that period with the client's express consent, or for digital content the client has consented to receive immediately), professional liability, the governing law clause, and any cross-jurisdictional considerations relating to future relocation, should be confirmed against your final operational practices and the law applicable at the time of publication.
